Terms of Use

1. Who we are and acceptance
TallyFelt is operated by Cayres Labs LLC (“Cayres Labs,” “we,” “us,” or “our”). These Terms govern your access to TallyFelt’s website, practice tools, paid features, and support services (collectively, the “Service”). By using the Service or purchasing a plan, you agree to these Terms and to our Privacy Notice.

2. Eligibility and U.S. availability
The Service is offered for users in the United States who are at least 18 years old. Do not use TallyFelt if you do not meet these requirements. You are responsible for complying with laws that apply to you and for deciding whether use of this educational product is appropriate for you.
3. Educational and simulated-practice scope
TallyFelt presents rules, drills, charts, examples, and feedback for practice. It does not maintain a practice currency or monetary balance, tell you how to make real-money decisions, or recommend an amount for any activity. Practice accuracy is not a promise of performance outside TallyFelt.
4. Plans, trial, and cancellation
Current plan options, trial terms, recurring charges, cancellation steps, and refund language are described on our Billing, Trial & Cancellation Policy and at Stripe Checkout before purchase. Monthly and annual subscriptions can be managed through the Stripe Customer Portal. Please review those terms before starting a trial or making a purchase.
5. License and acceptable use
Subject to these Terms and any applicable payment, Cayres Labs grants you a limited, personal, non-transferable, revocable license to use the Service for lawful individual practice. You may not:
- use the Service to facilitate unlawful conduct, evade venue rules, or misrepresent TallyFelt’s purpose;
- use automation, scraping, reverse engineering, or interference to access or disrupt the Service, except where applicable law cannot be waived;
- share, sell, sublicense, or transfer a paid license or access credential;
- copy, republish, or commercially exploit TallyFelt content, software, branding, or materials without written permission; or
- use the Service in a way that harms others or violates applicable law.
6. Ownership
The Service, including its software, graphics, content, trademarks, and design, is owned by Cayres Labs or its licensors and is protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
7. Availability and changes
We may update, maintain, suspend, or discontinue features to operate, secure, improve, or comply with law. We do not guarantee uninterrupted availability or that any specific feature will remain available indefinitely. Material changes to paid access will be communicated when required by law or contract.
8. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind. Cayres Labs does not warrant that the Service will be uninterrupted, error-free, suitable for a particular purpose, or produce a particular result outside the Service.
To the maximum extent permitted by law, Cayres Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses arising from decisions made outside the Service. Nothing in these Terms limits liability that cannot lawfully be limited.
9. Governing law
These Terms are governed by California law, without regard to conflict-of-law principles, except where mandatory consumer-protection law provides otherwise.
